Terms & Conditions.
The terms that apply when you use this website. Please read them carefully: by using the site, you agree to them.
1. About these terms.
These terms and conditions (“Terms”) govern your access to and use of this website, including its pages, articles, downloadable documents and the “Book a Call” enquiry form (together, the “Website”). By using the Website you confirm that you accept these Terms. If you do not agree, please do not use the Website.
These Terms apply to use of the Website only. Any consulting, creative or other services we provide are governed by a separate written proposal, engagement letter or contract agreed with the client (an “Engagement Agreement”). If there is a conflict, the Engagement Agreement takes precedence.
2. Who we are.
The Website is operated by Euston Business Consulting Ltd (“EBC”, “we”, “us”, “our”), a company registered in England and Wales under company number [company number], with its registered office at [registered office address], London, United Kingdom. VAT number: [VAT number, if registered].
You can contact us at taalish.khan@eustonbusinessconsulting.com.
3. Using our website.
You may use the Website for lawful purposes only. You agree not to:
- use the Website in any way that breaches applicable local, national or international law or regulation, or that is fraudulent or harmful;
- attempt to gain unauthorised access to the Website, its server, its administration area or any connected system or database;
- introduce viruses, malware or other harmful material, or attack the Website through denial-of-service or similar attacks;
- use automated systems (such as bots, scrapers or crawlers) to extract content or data from the Website, other than standard search-engine indexing, without our written permission;
- submit false, misleading, abusive or unsolicited promotional content through our enquiry form, or submit another person’s details without their permission; or
- interfere with or disrupt the Website or other people’s use of it.
Breaching this section may be a criminal offence under the Computer Misuse Act 1990. We may report such breaches to the relevant authorities and co-operate with them, and your right to use the Website will end immediately.
4. No professional advice.
The content on the Website, including our Insights articles, case studies, service descriptions, portfolio documents and any figures or results quoted, is provided for general information only. It is not professional, financial, legal, tax or other advice and does not take your particular circumstances into account. You should obtain advice specific to your situation before acting, or refraining from acting, on any content on the Website.
Case studies and results describe past work for particular clients. They are illustrative and are not a guarantee or prediction of the results you will achieve.
5. Enquiries and engagements.
Submitting an enquiry, booking a call or receiving information or a proposal from us does not create a contract between you and us or oblige either of us to enter into one. Any proposal we send is an invitation to agree terms. A contract is only formed when an Engagement Agreement has been agreed in writing by both parties.
When you send us an enquiry, you confirm that the information you provide is accurate and that you are authorised to share it. We handle the personal data in your enquiry as described in our Privacy Policy.
6. Intellectual property.
The Website and its content, including text, graphics, imagery, video, design, layout, software code, the EBC name and logo, and all downloadable documents, are owned by or licensed to us and are protected by copyright, trade mark and other intellectual property laws worldwide. All such rights are reserved.
You may view the Website, print or download extracts and share links to it for your own personal or internal business reference, provided that you keep any copyright and other notices intact and do not modify the material. You must not otherwise copy, reproduce, republish, distribute, sell or create derivative works from any part of the Website, or use it to train artificial intelligence or machine-learning systems, without our prior written permission.
Names, logos and trade marks of clients, partners and other third parties shown on the Website belong to their respective owners. They are used for identification and reference purposes and do not imply any endorsement beyond the work described.
7. Third-party links and content.
The Website may contain links to websites, services and resources operated by third parties, including social media platforms. These links are provided for your convenience only. We have no control over their content or practices and accept no responsibility for them or for any loss or damage that may arise from your use of them. A link does not mean we endorse the linked site.
8. Availability and changes.
The Website is provided free of charge on an “as is” and “as available” basis. We aim to keep it available and accurate, but we do not guarantee that it, or any content on it, will always be available, uninterrupted, error-free, secure, complete or up to date. We may update, suspend, withdraw or restrict access to all or part of the Website at any time, for business or operational reasons, without notice.
You are responsible for configuring your own devices and software to access the Website and for using your own virus protection.
9. Our liability to you.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales. Nothing in these Terms affects your statutory rights as a consumer.
Subject to the paragraph above, and to the fullest extent permitted by law:
- we exclude all conditions, warranties, representations and other terms that may apply to the Website or its content, whether express or implied;
- we will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with use of, or inability to use, the Website, or use of or reliance on any content on it; and
- in particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; loss or corruption of data; or any indirect or consequential loss or damage.
We will not be liable for any loss or damage caused by a virus, denial-of-service attack or other technologically harmful material that may infect your equipment, programs, data or other material because of your use of the Website or your downloading of any content from it or from any website linked to it.
Our liability in connection with any services we provide is governed solely by the relevant Engagement Agreement.
10. Privacy and cookies.
Our Privacy Policy explains how we collect and use personal data, and the cookies section explains the limited, strictly necessary cookies the Website uses. Both form part of these Terms.
11. General.
- Changes to these Terms. We may revise these Terms at any time by updating this page. The “last updated” date shows when they were last changed. Please check this page whenever you use the Website; continued use after a change means you accept the revised Terms.
- Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
- No waiver. If we do not insist on you performing any of your obligations, or delay in enforcing our rights, that does not mean we have waived them.
- Transfer. We may transfer our rights and obligations under these Terms to another organisation. You may not transfer yours without our written consent.
- Third-party rights. These Terms are between you and us. No other person has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
- Events outside our control. We are not responsible for any failure or delay in providing the Website caused by events outside our reasonable control.
12. Governing law and disputes.
These Terms, their subject matter and their formation, including any non-contractual disputes or claims, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts, and if you are a consumer living elsewhere you keep the protection of any mandatory provisions of the law of the country where you live.
If you have a concern, please contact us first. Most issues can be resolved quickly and informally.
